This document defines the Terms of Use (hereinafter "ToU") of the website of the European Fund for Inclusion and Development Support (EFIDS), accessible at www.efids.org.

EFIDS is an international non-governmental organization dedicated to inclusive development and reducing inequalities worldwide. Our mission is to support innovative projects that promote social, economic, and digital inclusion of the most vulnerable populations.

• "User" : any natural or legal person who accesses the Website and uses the Services, whether they are beneficiaries, partners, donors, or simple visitors.

5. Use of the website and services

General obligations of Users

The User undertakes to:

• Use the Website in accordance with its intended purpose and in compliance with these ToU
• Respect applicable legislation, particularly regarding intellectual property, data protection, and anti-discrimination
• Not harm public order and good morals
• Provide accurate, complete, and up-to-date information during any registration or submission

Prohibitions

Sanctions

EFIDS holds all intellectual property rights on:

• Developed software and applications

Authorized use

The User is authorized to:

EFIDS responsibility

• Not harming EFIDS's image and reputation

Termination by the User

Termination by EFIDS

EFIDS may terminate a User's access in case of:

• Violation of these ToU
• Fraudulent or abusive use of the Website
• Behavior harming EFIDS's image or interests
• Prolonged User Account inactivity (more than 2 years)

Effects of termination

Termination results in:

• Immediate cessation of access to Services
• Deletion of the User Account
• Retention of data necessary for legal obligations
• Maintenance of obligations prior to termination

12. Applicable law and competent jurisdiction

Applicable law

These ToU are governed by French law, subject to mandatory public order provisions of national legislation applicable to Users.

In case of conflict between the provisions of these ToU and mandatory national laws, the latter prevail within the limits of their scope of application.

Dispute resolution

In case of dispute relating to the interpretation or execution of these ToU, the parties will endeavor to resolve it amicably.

Mediation

In accordance with consumer regulations, EFIDS adheres to the following mediation service:

Competent jurisdiction

Failing amicable resolution, any dispute will be brought before the competent courts of Paris, France, except contrary public order provisions.

For Users residing in the European Union, the competent courts of their State of residence may also be seized in accordance with applicable European regulations.
